OGSO Limited Warranty Policy
Valid as of April 2019OGSO products are covered against manufacturing and material defects for one year from the date of purchase.
If a product is defective, OGSO or the authorized retailer repairs or replaces it at no charge.
Keep your proof of purchase. You will need it for any claim.
OGSO distributes its products through its worldwide network of authorized OGSO distributors and retailers. Below you will find all warranty details offered by OGSO and OGSO authorized retailers.
From the date of retail purchase by the original purchaser, for all products.
Manufacturing or material defects discovered within the warranty period.
At no charge, within a reasonable period, at OGSO's sole discretion.
I. Limited Warranty
OGSO provides this warranty to consumers who purchased an OGSO product ("Product(s)") from OGSO or one of its authorized retailers. OGSO warrants all new Products to be free from manufacturing or material defects ("Defects") for the Warranty Period defined below. This warranty applies only against Defects discovered within the Warranty Period and extends only to the original purchaser of the Product. OGSO Products meet their description and specifications; it is your responsibility to ensure that the Products you purchase are designed for the specific use according to the Product's purpose.
This warranty is valid and enforceable only in the country where the Product was purchased by the original purchaser, provided that OGSO has intended that the Product be offered for sale in that country. This warranty is also enforceable in any country within the European Economic Area where OGSO has an authorized importer, subsidiary or distributor. Please refer to the list of authorized retailers and distributors on the OGSO website. Depending on the country, particular and variable warranties may apply in relation to applicable legislation. Nothing in this warranty policy can exclude or limit these statutory provisions.
Warranty Period
The Warranty Period starts on the date of the retail purchase of the Product by the original purchaser. The Product may consist of several different parts, and different parts may be covered by different Warranty Periods (please refer to the Warranty Periods below for all warranties that may apply to your Product).
The Warranty Period is: one (1) year for all Products.
To the extent permitted by national laws, the Warranty Period will not be extended, renewed or otherwise affected by subsequent resale, repair or replacement of the Product. However, part(s) repaired or replacement Product(s) issued during the Warranty Period will be warranted for the remainder of the original Warranty Period only, provided that such replacement or repair has been performed by OGSO or an authorized OGSO retailer.
Depending on the country, particular and variable Warranty Periods may apply in relation to applicable legislation. Nothing in this warranty policy can exclude or limit such legislation.
II. Conditions and Restrictions
This Limited Warranty does not cover:
- Normal wear and tear of the Product
- Defects caused by transportation (other than the initial delivery from OGSO to the purchaser) or storage of the Product
- Defects or damage caused by improper use or poor maintenance
- Damage due to non-observance of the instructions in the product owner's manual
- Damage due to any modification of the Product
- Any impact caused by sharp items, torsion, compression, a fall, an abnormal impact or other actions not under OGSO's reasonable control
This Limited Warranty is not enforceable if:
- The Product has been modified or repaired by any person or entity other than OGSO or an authorized OGSO retailer
- The Product has been repaired with unauthorized spare parts
- The Product serial number has been removed, deleted, altered or made illegible
- There is no proof of purchase (receipt) showing the name of the distributor or retailer, the place and the date of purchase
- The Product was bought at a second-hand store, outlet store or other stockist
III. Warranty Enforcement
OGSO or its authorized retailer shall, at its sole discretion, either (a) repair the Product or (b) replace the Product at no charge. The appropriate remedy will be determined by OGSO based on the following considerations: (a) the value of the Product with no Defect, (b) the significance of the Defect, and the inconvenience each remedy would place on the original purchaser. OGSO agrees that all repair or replacement of the Product will occur within a reasonable period.
For all warranty claims, please submit the Product and the proof of purchase to the authorized OGSO retailer where the item(s) were purchased. If you purchased the Product directly from OGSO, please contact us.
IV. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable mandatory laws, this Limited Warranty is your sole and exclusive remedy and is in lieu of all other warranties, express or implied. OGSO shall not be liable for special, incidental, punitive or consequential damages, including but not limited to loss of anticipated benefits, loss of use, loss of revenue, cost of any substitute equipment or facilities, claims of third parties, or damage to property resulting from the purchase or use of the Product or arising from breach of warranty, breach of contract, negligence, strict tort, or any legal or equitable theory, even if OGSO knew of the likelihood of such damages. OGSO shall not be liable for delay in rendering warranty service.
If OGSO products are used for dangerous activities, please make sure that you learn how to use the products and choose an environment that suits their functionality. Be aware that activities in the mountains can cause serious damage to your health and even death. Do not use OGSO products under any circumstances in dangerous places without guidance and adequate security measures.
Secure your activity so that you are not at risk of injury. Always remember: MOUNTAINS ARE HILLY SO DON'T BE SILLY.
