1. About these terms

This website is operated by OGSO Europe Ltd., 4 MVintage Business Centre, Level 2, Triq il-Ġnien, Naxxar NXR 2480, Malta ("OGSO", "we", "us"). By using the website you agree to these Terms & Conditions. If you do not agree, please stop using the website. Our Privacy Policy, Cookie Policy and Warranty Policy are also part of how we work with you.

2. Who may use this website

The website is intended for businesses, professionals and interested visitors who are at least 18 years old. Authorized OGSO distributors and retailers may use the materials we provide to them for promoting OGSO products, under the conditions we give them.

We try to show our products as accurately as possible, but colors, features and specifications on the website may differ slightly from the actual product, and your screen may not show colors exactly. Information on the website is not a binding offer. Products are subject to availability, and we may change or discontinue products and prices at any time.

5. Orders and business customers

OGSO sells to businesses only, such as distributors and retailers. Sales to the end consumer are made by our authorized retailers, who are responsible for their own terms of sale. Orders are not placed or paid for on this website.

For business customers, prices, payment terms, delivery and other commercial conditions are set out in our written offer, price list or order confirmation. A contract is formed only when we confirm your order in writing. We may refuse or limit an order, and we may correct errors in prices or availability. Our Warranty Policy explains the guarantee that applies to our products. If a written agreement between you and OGSO conflicts with these terms, the written agreement applies.

Activities in the mountains involve serious risks, including injury and death. Learn how to use our products properly, choose conditions and terrain that suit your skills and equipment, and use proper guidance and safety measures. OGSO products must not be used in dangerous places without them. Always remember: MOUNTAINS ARE HILLY SO DON'T BE SILLY.

12. Governing law and disputes

These terms are governed by the laws of Malta. If a dispute arises, both sides first try to resolve it informally by written notice and negotiation for at least 14 days. If this does not work, the courts of Malta have jurisdiction, unless mandatory law gives you the right to go to another court. Disputes about intellectual property rights or requests for urgent court orders may be brought straight to court.

13. General

If a part of these terms is found to be invalid, the rest stays in force. If we do not enforce a right, this does not mean we give it up. We may transfer our rights and obligations under these terms to another company. We are not responsible for delays or failures caused by events beyond our reasonable control.

We may update these terms from time to time. The date at the top shows the latest update, and the new version applies from the date it is published on this page.
